Terms and Conditions for School Daze Tutors Clients

  1. Introduction

Welcome to School Daze Tutors. By enrolling in our services, you acknowledge and agree to abide by the terms and conditions outlined in this document. These terms are legally binding and adhere to South African consumer law and the South African Schools Act.

  1. Service Provision

  • School Daze Tutors facilitates connections between parents/students and independent tutors.
  • All tutors are independent contractors and are responsible for managing their own schedules and conduct.
  • School Daze Tutors and its website are not liable for tutors’ actions, behaviors, or values.
  1. Scope of Services

  • The Agency agrees to provide online tuition services to the Client according to the terms and conditions outlined in this Agreement. These services include but are not limited to tutoring sessions, academic guidance, and educational support as agreed upon between the Agency and the Client.
  • The specific scope of services to be provided will be determined based on the Client’s educational needs and requirements, as discussed and agreed upon by both parties prior to the commencement of lessons.
  • Any additional services requested by the Client beyond the scope of this Agreement must be negotiated and agreed upon in writing. Additional fees may apply for such services.
  1. Payment and Refund Policy

  • All payments are final, and no refunds or reimbursements will be provided under any circumstances.
  • Lessons canceled with less than 24 hours’ notice are not eligible for a refund but may be rescheduled at the discretion of the tutor.
  1. Cancellation and Rescheduling Policy

  • Clients must notify the tutor at least 24 hours in advance to cancel or reschedule a lesson.
  • Failure to provide timely notice will result in the session being charged in full.
  • If a client cancels a lesson, they will be given the option to reschedule. Failure to reschedule will result in the forfeiture of the session.
  1. Professional Conduct

  • Tutors are required to maintain professionalism during all interactions with clients.
  • Similarly, parents and students must maintain a respectful and professional attitude toward tutors.
  • Parents/clients are prohibited from:
    • Requesting personal or private information from tutors.
    • Engaging in any form of harassment, abuse, or misconduct toward tutors.
  1. Changing a Tutor or Reporting Misconduct

  • Requesting a Tutor Change:
    If a parent wishes to change their allocated tutor, they must:
    1. Visit the review page on the School Daze Tutors website.
    2. Submit a formal request for a new tutor to be allocated.
    3. Provide a valid reason for the request, supported by screenshot evidence of any indiscretion or misconduct by the current tutor.

  • Reporting a Tutor:
    To report a tutor for inappropriate behavior or misconduct:
    1. Contact School Daze Tutors through the designated communication channels (email: info@schooldazetutors.co.za).
    2. Provide a detailed explanation of the issue, accompanied by relevant evidence (e.g., screenshots or correspondence).
    3. Allow School Daze Tutors time to investigate and address the matter appropriately.

  • Important Note:
    Requests or complaints without valid reasons or supporting evidence will not be processed.
  1. Confidentiality of Resources and Services

  • Intellectual Property:
    All resources, lesson plans, and materials provided by tutors through School Daze Tutors are the intellectual property of the tutor or the platform and are for personal, non-commercial use by the client.
    • Clients may not copy, distribute, or share these materials without explicit written permission from School Daze Tutors or the tutor.
    • Unauthorized use, duplication, or dissemination of resources will result in immediate termination of services and may lead to legal action.

  • Confidentiality of Services:
    • The details of any lessons, communications, or interactions between tutors and clients are confidential and may not be disclosed to third parties without consent.
    • Clients and tutors must respect each other’s privacy and avoid sharing personal information or correspondence without prior approval.

  • Platform Privacy Policy:
    All client information provided during registration or throughout the use of School Daze Tutors’ services will be handled in accordance with our Privacy Policy and South African data protection laws. No personal details will be shared with third parties without consent unless required by law.
  1. Queries and Concerns

  • All client queries, concerns, or complaints must be directed to School Daze Tutors via email at info@schooldazetutors.co.za or through our official communication channels.
  • Direct disputes with tutors are discouraged and should be escalated to School Daze Tutors for resolution.
  1. Termination of Services

  • Advance Bookings:
    If a client has booked lessons for a full month in advance, the following conditions apply:
    • Clients may terminate their membership with School Daze Tutors at any time; however, the no refund policy [see point 4 of this document] remains in effect, and no reimbursements will be issued for unused lessons, however should the client choose to use the allocated lesson slot they may do so.
    • The client is responsible for the payment of all fees for lessons that have already been rendered up to the termination date.

  • Outstanding Fees:
    Any outstanding payments for services rendered prior to termination must be settled in full before the client’s membership is officially terminated.

  • Notification of Termination:
    Clients must provide written notice of termination via the designated communication channels (email: info@schooldazetutors.co.za). Failure to provide formal notice will result in the continuation of charges for scheduled lessons.

  • Rescheduling of Pre-Booked Lessons:
    Clients who terminate their membership may request to reschedule any pre-booked lessons within the remaining period, subject to the tutor’s availability and the 24-hour cancellation/rescheduling policy [see point 5 of this document].
  1. Rights of Tutors and Students

  • All parties have the right to a safe and respectful environment.
  • Tutors have the right to refuse any form of harassment or undue demands.
  • Students have the right to receive lessons in a respectful and supportive setting.
  1. Limitation of Liability

  • Independent Contractor Acknowledgement:
    • All tutors listed on the School Daze Tutors platform operate as independent contractors. School Daze Tutors, including its owner and affiliates, are not responsible for the actions, conduct, or performance of individual tutors.

  • No Guarantee of Outcomes:
    • School Daze Tutors provides a platform to connect clients with independent tutors and does not guarantee specific learning outcomes, academic results, or personal development progress.

  • Conduct and Safety:
    • While we take reasonable steps to verify the credentials and background of tutors, School Daze Tutors cannot guarantee the character or conduct of any tutor. If a tutor is reported for any inappropriate, abusive, or unsafe behavior—especially involving children—we will take immediate and appropriate action, which may include removing the tutor from the platform and cooperating fully with relevant authorities and parents/guardians.
    • Children are assumed to be supervised by a responsible adult at all times during the lessons.
  • Zero Tolerance Policy:
    • School Daze Tutors maintains a zero-tolerance policy toward any form of abuse, exploitation, or inappropriate conduct. Reports of such behavior will be treated seriously and handled with urgency. The platform is committed to supporting affected families and ensuring child safety at all times.

  • Indemnification:
    • Clients and tutors agree to indemnify and hold harmless the company School Daze Tutors (PTY LTD), including its owner and affiliates, from any claims, damages, liabilities, or expenses arising out of or in connection with their use of the platform, including but not limited to disputes between tutors and clients.

  • Limitation of Damages:
    • To the fullest extent permitted by law, School Daze Tutors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from the use or inability to use the platform or the services of any tutor.
  1. Governing Laws

  • These terms and conditions are governed by the laws of South Africa and are in alignment with the South African Schools Act.
  1. Acknowledgment

By signing this document & by use of the website, you acknowledge that:

  • You have read and understood the terms and conditions outlined above.
  • You agree to abide by these terms as a client of School Daze Tutors.
